Notice to Member’s Panel: Terms and Conditions regarding referrals – AF
We are Personal Injury lawyers and we may accept referrals of business from third parties provided we adhere to the Solicitor’s Introduction and Referral Code. This means that whether you are an individual or a business, you can become one of our panel members by referring clients to us in return for a commission.
When receiving referrals of clients from you, we must do nothing that would compromise our independence or our ability to act and advise in the best interests of the clients you refer to us.
If the person you wish to refer to us has a claim resulting from death or personal injury, we can only enter into a referral arrangement with you provided you do not have an additional arrangement with that person entitling you to a percentage of his or her damages (also known as a contingency fee).
Our referral arrangement with you must comply with the above Code. The requirements are:
- the agreement between us must be in writing
- you must tell the person whom you wish to refer to us that you have a financial arrangement with us
- you must tell the person whom you wish to refer to us the amount of commission you are receiving as a result of the referral
- you must not have an arrangement with the person whom you wish to refer to us entitling you to take a percentage of their damages.
You may also wish to advertise our legal services in order to gain more referrals and hence more commission for you. If you advertise our services, you should publicise your adherence to the code by means of a notice on the following lines:
“We comply with the Solicitors Instructions and Referral Code published by the Law Society. We shall refer you to Hafezis/ Lawclaim who are independent professionals, from whom you will receive impartial and confidential advice. You are free to choose another solicitor
Please note that if we have any reason to believe that you have breached any of the above terms, we will take all reasonable steps to ensure that the breach is remedied. If the breach continues, we will terminate the agreement with you.
