Claims Against Insurers
It is compulsory to take out insurance policy to drive a motorcar in England and Wales. In the very minimum you are required to have a third party policy. This means that if you are involved in an accident and it is your fault you should have an insurance policy that covers any loss and damage that you cause to the third parties. I.e. Other motorists and pedestrians. As an employer you are also required to take out insurance policies to cover any loss and damage that your employee may suffer during the course of their employment. This is called an employer liability policy.
Similarly employers are also required to take out insurance policies to cover loss and damage suffered by visitors to their premises. This is called public liability policy.
There is a contract of insurance and often insurance policies are bought by completing a proposal form. There is a duty on you as a proposer to complete the form in good faith. This means you should tell the insurer all facts about the history of yourself, your company/firm. Whether or not you consider that to be relevant.
In many instances an insurance company will cancel the policy ab initio (as if it was never taken out) returning your premium if you make a claim on that policy. They would do so if they find out once you presented a claim that you have not given them information which they consider to be material when agreeing to underwrite your risk.

Contracts of insurance have a limitation of six years from the date of your loss. It is therefore important to present your claim and seek advice as soon as possible as evidence is crucial.
